This privacy and cookie management policy (hereinafter the “ Privacy Policy ") is intended to define the terms and conditions according to which the company SOCIETE INDUSTRIELLE DE CONSTRUCTION HABITAT (hereinafter " SIC HABITAT ") may process the personal data of natural persons who are customers, prospects or candidates for employment (hereinafter the " Users ”) who use the Website www.sic-habitat.com (hereinafter referred to as the " Website ”) and resort to the use of cookies when browsing the Website.

For any question or request for information concerning the Website, and for the exercise of their rights as listed in article 5 below, the User can contact SIC HABITAT at the e-mail address above. or by sending a registered letter with acknowledgment of receipt to the postal address above.

2. LEGAL BASES AND PURPOSES OF PROCESSING PERSONAL DATA

Through " Personal data means any personal data relating to an identified or identifiable natural person.

In application of European and French legislation on the protection of Personal Data (European Regulation n ° 2016/679 of April 27, 2016 relating to the protection of personal data known as "RGPD" and Data Protection Act n ° 78-17 of January 6 1978), SIC HABITAT processes the Personal Data of Users only for the purposes and under the legal bases defined below.

2.1. Processing carried out for the purpose of responding to an online contact request or requests made to our virtual assistant

As part of its activity, SIC HABITAT allows Users to request to be contacted.

For this, the User must complete a form.

In order to manage the User's contact request, SIC HABITAT processes the following Personal Data:

  • first and last name,
  • address,
  • e-mail address,
  • phone number,
  • nationality
  • all Personal Data likely to be contained in the information communicated by the User in the context of his message, including his answers in the context of his exchanges with our virtual assistant.

The processing of this Personal Data by SIC HABITAT is necessary for the management of contact requests created by Users (legal basis: art. 6.1.b of the GDPR – execution of pre-contractual measures taken at the request of the person concerned).

2.2. Processing carried out for the purpose of distributing the newsletter / articles on the activity of SIC HABITAT

The User can, if he wishes, receive the SIC HABITAT newsletter by email.

With his consent, SIC HABITAT collects and processes the following Personal Data concerning him:

  • E-mail adress.

The processing of this Personal Data allows SIC HABITAT, with the consent of the User, to send him the newsletter (legal basis: art. 6.1.a of the GDPR – consent of the person concerned).

The User may withdraw their consent at any time regarding this processing. However, any processing carried out before this withdrawal will remain lawful.

2.3. Processing carried out for the purpose of processing job applications

The User can send an unsolicited application to SIC HABITAT to join its staff, via the "JOIN US" tab available on the Website.

He can also send his application by post or email to SIC HABITAT.

In order to process applications, SIC HABITAT processes the following Personal Data:

  • last name First Name,
  • e-mail address,
  • curriculum vitae content,
  • any Personal Data that may be contained in the message sent by the User.

The processing of this Personal Data by SIC HABITAT is necessary for the processing of applications (legal basis: art. 6.1.b of the GDPR – execution of pre-contractual measures taken at the request of the person concerned / art. 6.1.a of the GDPR – consent of the person concerned.

2.5. Processing carried out for the purposes of fulfilling legal obligations

SIC HABITAT may process any Personal Data concerning the User when this processing is strictly necessary to comply with its legal obligations (legal basis: art. 6.1.c of the GDPR – compliance with a legal obligation).

3. RECIPIENTS OF PERSONAL DATA

3.1. Internal services of SIC HABITAT

SIC HABITAT shares Users' Personal Data with its internal departments, for the sole purposes defined in Article 2 above and for which they are authorised.

3.2. External recipients

SIC HABITAT shares Users' Personal Data with recipients
following.

  • The companies of the group to which SIC HABITAT belongs, i.e. the companies:
    • COMPANY OF STUDY & REPRESENTATION IN BUILDING (registered with the Register of Commerce and Companies of Agen under the number 322 687 179) which carries out technical studies on behalf of SIC HABITAT
    • SIC ENTREPRISE (registered in the Trade and Companies Register of Agen under number 410 597 835) which provides construction services on behalf of SIC HABITAT
    • SMP (registered in the Trade and Companies Register of Agen under number 415 395 896) which carries out technical studies on behalf of SIC HABITAT
    • GEFIM (registered in the Trade and Companies Register of Agen under number 439 873 548), which provides consulting and assistance services to companies for all matters relating to their development.
  • The service providers of SIC HABITAT, i.e. the companies:
    • EKONSILIO which offers the User the possibility of requesting a conversational agent
    • KINSTA which provides hosting of Personal Data
    • VR Interactive which provides webmaster activities to manage the Website
    • EUDONET, CRM of SIC HABITAT

3.3. Administrative and judicial authorities (if necessary)

In the only cases where this communication is required by a legal obligation, SIC HABITAT communicates the Personal Data of the Users to the administrative or judicial authorities which require it.

4. CONSERVATION OF PERSONAL DATA

SIC HABITAT retains Users' Personal Data for the period required to fulfill the purposes described in this Privacy Policy. The criteria used to determine the retention period include: (i) the duration of the relationship between SIC HABITAT and the User; (ii) if there is a legal or commercial obligation to which SIC HABITAT is subject; or (iii) if a longer retention period is required or permitted by law.

2 years from the last contact with the candidate, unless the latter wishes his personal data to be deleted earlier

 

5. USER RIGHTS

The User has the following rights over the Personal Data that is collected:

  • access, update, modify or request deletion of their Personal Data;
  • request the limitation and/or oppose the processing of their Personal Data from the Website;
  • request the portability and transfer of their Personal Data from the Website, for their own use or to any other data controller.
